4. COMPANY INFORMATION
Bike Out is a travel agency whose activity is subject to the provisions of articles L211-1 and following of the Tourism Code. Its core business is to offer tourist programs by bicycle or motorbike.
The Site as well as any dispute relating to the use of the Site to which Bike Out is a party, are subject to French law.
These legal notices as well as the general conditions of use of the Site are subject to the regulations applicable in France in terms of consumption, tourism, or contracts concluded remotely and via the Internet, and in particular the provisions of the Code of consumption, the Tourism Code, the Civil Code, Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, or the Intellectual Property Code and Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms (hereinafter referred to as the "Data Protection Act").
5. PERSONAL DATA
In accordance with the provisions of the Data Protection Act, Bike Out undertakes to respect the personal data of users of the Site (hereinafter referred to as "Users"), in the context of the request for a quote, the reservation and the participation in Tourist Services, or during any exchange with them in the context of his professional activity. The personal data of a User is the information which makes it possible to identify him directly or indirectly, within the meaning of article 2 of the Data Protection Act. Users are required to provide this type of information (surname, first name, email or postal address, etc.) voluntarily when requesting an online quote and, where applicable, when making a reservation with Bike Out. The personal data collected by Bike Out may be used by it, by its employees or by its service providers for the purpose of providing tourist services to Users as part of its activity, and in particular for the purpose of processing reservations made with Bike Out or to respond to any request or question concerning the Site or the services offered as part of the tourist services. Users are informed that Bike Out is likely to communicate their personal data to third parties, subject to the express and prior consent of the user concerned or any competent public authority when the laws and regulations require it. Bike Out will keep users' personal data in a strictly confidential manner and may only be used for the purposes for which they were collected and for purposes to which the Users concerned have expressly consented, in compliance with the provisions of the Data Protection Act. For any other use of Users' personal data, for purposes other than those mentioned above, Bike Out undertakes to obtain the prior consent of the Users concerned in accordance with the provisions of the Data Protection Act. In accordance with the provisions of articles 38 and following of the Data Protection Act, any User has a right of opposition, access, rectification or deletion of his personal data, which he is free to exercise by contacting Bike Out at the contact address provided herein.
7. REMOVAL OF INAPPROPRIATE OR ILLEGAL CONTENT
Bike Out undertakes to remove any manifestly illegal content that would be validly notified to it in accordance with the following provisions of article 6.I.5. Law No. 2004-575 of June 21, 2004 on confidence in the digital economy:
“5. Knowledge of the disputed facts is presumed to have been acquired by the persons named in 2 when they are notified of the following elements:
- if the notifier is a natural person: his surname, first name, email address; if the notifier is a legal person: its corporate form, its corporate name, its email address; if the notifier is an administrative authority: its name and email address. These conditions are deemed to be satisfied when the notifier is a registered user of the online public communication service mentioned in the same 2, that he is connected at the time of making the notification and that the operator has collected the elements necessary to its identification;
- the description of the disputed content, its precise location and, where applicable, the e-mail address(es) to which it is made accessible; these conditions are deemed to be satisfied when the online public communication service mentioned in said 2 makes it possible to proceed precisely with this notification by a technical device directly accessible from the said disputed content;
- the legal grounds on which the disputed content should be removed or made inaccessible; this condition is deemed to be satisfied when the online public communication service mentioned in the same 2 allows the notification to be made by a technical device proposing to indicate the category of offense to which this disputed content may be attached;
-a copy of the correspondence addressed to the author or publisher of the contentious information or activities requesting their interruption, withdrawal or modification, or justification that the author or publisher could not be contacted ; this condition is not required for the notification of the offenses mentioned in the third paragraph of 7 of this I as well as in article 24 bis and in the third and fourth paragraphs of article 33 of the law of July 29, 1881 on the freedom of press. »
In addition, Bike Out reserves the right to remove as a preventive measure any content that may be considered illegal or inappropriate on the Site.
